Introduction

The PCOS Nutritionist Limited (we, us, our) complies with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information, including health information. Personal information is information about an identifiable individual (a natural person).
Our services aim to empower you to reduce and reverse your PCOS symptoms by providing lifestyle guidance and assistance. Our services are provided in a range of ways, including via the Ovie App,and online consultations with us.

This policy sets out how we will collect, use, disclose and protect your personal and health information. This policy applies to all users of our services. If you access or use our Website or Services (as those terms are defined in our Terms of Use) you authorise us to collect and use your personal and health information in accordance with: this policy; the Act.

This policy does not limit or exclude any of your rights under the Act or the Code.
We will never require you to give us any information or full information. But if you do not share with us all relevant information relating to your PCOS (including sharing your health information and/or be physically examined), we may be unable to plan and carry out safe and appropriate support for your individual needs. Given this, if you do not or cannot provide us with full information, we may refuse to provide you with services, or may provide incorrect services – if this happens, we will have no responsibility or liability to you.

Changes to this policy

We may change this policy by uploading a revised policy onto the Website. The change will apply from the date that we upload the revised policy.

Who do we collect your personal information from

We collect personal and health information about you from:
You, when you provide that personal and health information to us, including via the Website and any service, through any registration or subscription process, through any contact with us (e.g. telephone call or email), or when you buy or use our Services. If you use our services, you will be asked to fill out a detailed questionnaire that includes you providing lifestyle and general health information related to your PCOS symptoms. We will also collect information so that we can contact you, e.g. email and SMS details third parties where you have consented to this or the information is publicly available.
We also collect this from you in any consultations you have. We use an AI service to take detailed notes during your consultation. These notes will be used for the purpose of facilitating your healthcare and may be stored securely for future reference. If possible, we will collect personal and health information from you directly.


How we use your personal information

We will use your health information to obtain an understanding of your health and lifestyle so that we can provide services and products to you, including providing lifestyle guidance, a support plan, or a support programme.

We will use your other personal information:

  • to verify your identity
  • to obtain an understanding of your health and lifestyle so that we can provide services and products to you, including providing lifestyle guidance, a support plan, or a support programme;
  • to market our services and products to you, including contacting you electronically (e.g. by text or email for this purpose)
  • to improve the services and products that we provide to you
  • to bill you and to collect money that you owe us, including authorising and processing credit card transactions
  • to respond to communications from you, including a complaint
  • to conduct research and statistical analysis (on an anonymised basis)
  • to protect and/or enforce our legal rights and interests, including defending any claim
  • for any other purpose authorised by you or the Act.


Disclosing your personal information

We may disclose your personal and health information to:

  • your doctor or health care professional, and third parties who assist us in providing you with guidance – we will only do this with your prior consent
  • any business that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that we use to provide the website or other services and products
  • a credit reference agency for the purpose of credit checking you (but we will never supply your health information to this agency)
  • a person who can require us to supply your personal information (e.g. a regulatory authority)
  • any other person authorised by the Act or another law (e.g. a law enforcement agency)
  • any other person authorised by you.
  • A business that supports our services and products may be located outside New Zealand. This may mean your personal information is held and processed outside New Zealand.
  • Unless prohibited by law, if we are required by law to provide your health information to a third party (including a regulatory authority or law enforcement authority), we will advise you of this



Protecting your personal and health information

We will take reasonable steps to keep your personal and health information safe from loss, unauthorised activity, or other misuse.

Accessing and correcting your personal and health information

Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.
In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.

Retention of personal and health information

We will keep your personal and health information no longer than is needed to fulfil the purposes for which it is collected.

Internet use

While we take reasonable steps to maintain secure internet connections, if you provide us with personal and health information over the internet, the provision of that information is at your own risk.

If you post your personal and health information on the Website or App’s comments section/ forum or any of our message boards/chat rooms, you acknowledge and agree that the information you post is publicly available.
If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal and health information. We suggest you review that site’s privacy policy before you provide personal and health information.

We use cookies (an alphanumeric identifier that we transfer to your computer’s hard drive so that we can recognise your browser) to monitor your use of the website.
